The true guarantee of human rights is not achieved by texts alone, but rather by an integrated system that makes violating rights obligatory for parties violating human rights, for victims, and for parties negligent in preventing a human rights violation from occurring, and protecting them is a public interest that concerns all parties, to include the victim, human rights defenders, national human rights institutions, civil society organizations, and governmental authorities. These guarantees can be talked about in several axes; Among them is the first axis, represented by the rule of law and the independence of the judiciary. There is no value for any right if it is not enforceable. The independence of the judiciary, its impartiality, and the speed of adjudication of cases are the first practical guarantee. The independent judge is the one who transforms the right from a written text into actual protection on the ground.

The second axis that we can talk about is the axis of sincere political will. Constitutions may be advanced, but without the political will to respect them, they remain a dead letter. This is because respect for human rights begins from the top of the hierarchy of power, and appears in the commitment not to use the law to suppress opponents or justify violations. This means that the political will from the highest levels of government and other authorities moves the actual guarantee of human rights from the stage of speech to the stage of action and application, to become a general approach in society.

The third axis that we can talk about is accountability and non-impunity. Meaning that the true guarantee of human rights is that the violator be held accountable, regardless of his position, and the absence of accountability turns the violation into a policy, while deterrent justice turns it into an exception, with reference to accountability being one of the most important principles of good governance.

Community awareness and the role of the media represents the fourth axis, which we claim is one of the most important axes for human rights guarantees. A society that is aware of its rights is the first line of defense, including free media, legal education, and civil society organizations. These are oversight tools that prevent the normalization of violations and their disclosure to public opinion. A person who is aware of his rights, duties, powers, and powers will not accept being a perpetrator of any violation of any human rights or violating the law. He will not accept being a victim of human rights violations, because he knows His rights, which everyone must respect and not violate.

Economic and social independence represents the fifth axis of the true guarantee of human rights. Poverty, unemployment, and economic dependency make a person less able to claim his rights. Therefore, social justice is not a luxury, but rather a condition for the actual enjoyment of human rights, and from here the relationship between poverty and unemployment emerges. Whoever obtains his right to work and receive a wage emerges from the cycle of poverty, to be an active element in society, a participant in development, and a preserver of the environment. As a result, he will not accept being a victim whose rights are violated, and will be a human rights defender.

The sixth axis of the true guarantee of human rights is represented by “the international system… between text and reality.” Despite the existence of international charters, instruments, and major institutions such as the United Nations, and mechanisms for protecting human rights, including international mechanisms, regional mechanisms, national mechanisms, and international judicial mechanisms such as the International Criminal Court, regional judicial mechanisms, and national judicial mechanisms, their effectiveness remains dependent on the balances of international politics, as human rights globally still suffer from double standards.

In summary, the true guarantee of human rights is not an international document, nor just a constitutional article, but rather a state of law, an independent judiciary, political will, a conscious society, and justice that knows no exceptions. When the cost of violating a right becomes higher than the cost of respecting it, only then can we talk about a real guarantee, not slogans.
