After instructions were issued in the Official Gazette to regulate the practice of student partisan activities in higher education institutions, which were approved by the Ministry of Higher Education on the 4th of this month, an inquiry was raised whether these instructions, which are issued for the first time in the history of Jordan, will change the reality of the freedoms of partisan work in universities and for a generation. Last week, the National Center for Human Rights, in partnership with the Independent Election Commission, organized a symposium entitled (Regulating the practice of student partisan activities in higher education institutions), in the presence of a group of politicians, academics, university presidents, deans of student affairs, and a number of male and female students.
The coordinator of Thabahtouna, who participated in the symposium, revealed that the impression she got from it during her presence as a delegation to the campaign was that “the journey is very long, if not impossible.”
Daas said that one of the deans of student affairs said at the symposium that even if the system is implemented, we will not allow the “You Slaughter Us” campaign to hold any activity inside the university.
The following is the text of the order:
System No. ( ) for the year 2022
A system for regulating the practice of student party activities in higher education institutions
Issued in accordance with Paragraph (a) of Article (20) of the Political Parties Law No. (7) of 2022:
Article 1- This system is called (the system for regulating the practice of student partisan activities in higher education institutions for the year 2022) and it comes into force after one hundred and eighty days from the date of its publication in the Official Gazette.
Article 2- The following words and phrases, wherever mentioned in this system, shall have the meanings assigned to them below, unless the context indicates otherwise:
Council: Council of Higher Education.
Higher Education Institution: An institution that undertakes higher education, whether it is a university, university college, intermediate community college, or others.
Party: The political party established in accordance with the Political Parties Law.
Student: The female student or student who is a member of the regular party studying at the institution of higher education.
Deanship: The Deanship of Student Affairs or its equivalent in a higher education institution.
Dean: The Dean of Student Affairs or his representative in the institution of higher education.
Partisan activity: the activities that students are entitled to practice in a higher education institution in accordance with the provisions of this bylaw and the instructions issued pursuant thereto.
Campus:
The buildings, lands, gardens, squares, and service facilities of the Higher Education Institution designated for its work and activities, whether they occur within or outside the headquarters of the Higher Education Institution.
Article 3 – A – Students have the right to practice the following partisan activities on campus:
1- Awareness and party education.
2- Introducing the electoral process.
3 – Encouraging student participation in public work and in the elections organized by the higher education institution for student councils, unions, associations or student clubs therein.
4- Holding and participating in political seminars and debates.
5- Any other activity approved by the Deanship.
b- The activities referred to in Paragraph (a) of this Article represent the point of view of the students in charge of them or the party to which they belong, and do not in any way express the position or point of view of the higher education institution.
Article 4- When practicing partisan activity, the student is committed to the following:
A- Carrying out partisan activity in the places and times approved by the provisions of this system and the instructions issued pursuant thereto.
b- Obtaining the written approval of the deanship before announcing the establishment of the party activity, calling for it, or starting its implementation.
C- Preserving the integrity of the institutions of higher education and its facilities and the proper functioning of the educational process therein, and not taking any action that hinders its work.
d- Refrain from conducting partisan activity during exam periods and events held by the higher education institution, including graduating students.
E- Refraining from holding partisan activity a day before the date of the student councils, federations, associations, or student clubs elections and on the day the elections take place.
F- Refrain from using the name and logo of the higher education institution when practicing partisan activity.
g- Not collecting donations or receiving financial support for the party.
Article 5- The application for the establishment of partisan activity shall be submitted to the deanship at least ten days prior to the proposed date for its establishment on the form approved by the Council for this purpose, including the following: –
A- The title and purpose of the activity.
b- The names of at least three of the applicants.
c- A copy of the invitation to the activity.
d- The venue, proposed date and program for the activity.
E- The names of the main speakers in the activity.
f- The approval of the party’s general secretary to submit an application to establish the activity.
Article 6 – A – The Deanship is committed to issuing its decision regarding the application for establishing partisan activity within a period not exceeding five working days from the date of its submission.
B- In the event that the decision is not issued within the period stipulated in Paragraph (A) of this Article, the application is considered de facto approved.
C – The applicants have the right to object within three working days from the date of their notification of the rejection decision to the head of the higher education institution, and the decision issued by him is final.
D – After the issuance of the decision approving the establishment of partisan activity, the dean may change its time, place, or program, provided that the decision is reasoned.
E – The dean may stop partisan activity during its session if any act is committed that violates the legislation in force or public order.
Article 7-a- A higher education institution is prohibited from:
1- Questioning the student or attacking him because of the partisan activity that is allowed to be practiced in accordance with the provisions of this system and the instructions issued pursuant thereto.
2- Being biased in favor of any party or influencing the students belonging to the parties in any way.
3- Promoting any party by any means, including electronic means.
4- Allowing the use of any place on the university campus as a headquarters or office for the party.
B- The faculty members of the higher education institution and all its employees are prohibited from:
1 – Participation in partisan activities practiced by students on campus.
2 – Influencing students in any way because of their party affiliation.
Article 8 – The institution of higher education is committed to forming student councils, federations, associations, or student clubs, and providing the opportunity for all partisan and non-partisan students to exercise their right to run and be elected in any of them according to instructions issued by the Council for this purpose.
Article 9 – The institution of higher education is committed to amending any regulations or instructions issued by it that contradict the provisions of this system within a period not exceeding one hundred and eighty days from the date of its publication in the Official Gazette.
Article 10 – The provisions of this system do not apply to higher education institutions affiliated to the Jordanian Armed Forces or security services.
Article 11- The Council issues the necessary instructions to implement the provisions of this system.
