The General Assembly of Lawyers approves the establishment of the Emergency Assistance Fund for Lawyers

After a lengthy discussion, the General Assembly of the Bar authorized the Bar Council to re-study the legal aid system through the Legal Committee of the Bar taking into account its proposals that focused on preserving the independence of the Bar and not accepting any foreign funding.
The General Assembly, during its meeting held at the Professional Syndicates Complex headed by Head of the Bar, Yahya Abu Aboud, authorized the Syndicate Council to make amendments to the minimum fees system, taking into account the observations of the General Assembly.
The General Assembly of the Bar approved the establishment of an emergency assistance fund for lawyers, which provides assistance worth two thousand dinars to those who meet the conditions of the fund.
The Bar Association discussed the reasons for the legal aid system, including the broadening of the compulsory power of attorney, so that the association provides legal and judicial aid to those who are unable to bear the costs of fees in financial and administrative cases, as is the case in many countries of the world that allocate part of their budgets. for this help.
He added that the proposal of the system comes in conjunction with a tendency to find a legal aid law according to which a fund would be established to cover the costs of assistance, which would establish an entity that would finance and determine who would provide assistance and thus the possibility of conflict with the union law, and that the system guarantees the centralization of the union’s decision and the relationship between the union and the lawyer and provides opportunities for lawyers to fulfill their mission. An income helps the lawyer to perform his mission.
He indicated that according to the system, a fund would be established to be supervised by the Syndicate, the Ministry of Justice and the Judicial Authority, through a council headed by the Bar Association and comprising seven members, five of whom represent the Syndicate, a representative of the Ministry and another of the Judicial Authority.
The General Assembly suggested adding provisions limiting legal aid to the Syndicate, blocking access to legal aid centers, and not accepting foreign funding for the Legal Aid Fund.
The General Assembly had approved the financial report and approved the final account for the past year (2022), and the estimated budgets for the Syndicate, retirement, cooperation and health insurance funds for the current year (2023).
With regard to the Emergency Aid Fund, the fund will be established according to the Bar Law, and its resources will be from lawyers’ donations or any donations from a party approved by the Council, in addition to deducting an amount of five dinars annually from professors’ lawyers upon payment of the annual fee.
The amounts deposited in the emergency assistance account shall be disbursed by a decision of the Council for each accident or emergency case affecting lawyers, and that the amount of emergency assistance does not exceed two thousand dinars, provided that the case is not covered by the provisions of the retirement fund, health insurance fund, or cooperation fund, and that the case is not related to The lawyer’s financial obligations to the Bar, and the Bar Council issues written instructions regarding the entitlement and disbursement of assistance and its amount, and the amounts derived from this account are deposited in one of the banks in which the Bar Association’s funds are located, to be determined by the Board.
The Head of the Bar Association affirmed that the association will remain a fortress in defending Jordan, Palestine, the Arab world and the rights of the Arab peoples.
