Al-Fityani calls for the concerted efforts of unions and civil society institutions to help the debtors and the insolvent

Trade union activist Dr. Hisham Al-Fityani demanded in his statements to “compass“With the concerted efforts of everyone from trade unions, civil society institutions, and philanthropists to help the debtors and the insolvent, especially in light of the difficult circumstances imposed by the economic situation on Jordanian society, and their difficulty increased after the suspension of the defense law and the suspension of the prohibition of imprisonment of the debtor.

Al-Fityani said that our true Islamic religion was the first to be concerned with relieving distress for those in debt, and the hadiths contained in this are many, such as the hadith of the Prophet – may God’s prayers and peace be upon him -: “And whoever facilitates a hardship, God will facilitate it for him in this world and the Hereafter.” And the hadeeth: “Whoever would like God to save him from the hardships of the Day of Resurrection, let him relieve someone who is in difficulty or relieve him.”

He added, however, on the other hand, in the honorable hadith on the authority of Abu Hurairah, may God be pleased with him, on the authority of the Prophet, may God’s prayers and peace be upon him, he said: “Whoever takes people’s money, intending to perform it, God will fulfill it on his behalf, and whoever takes it intending to destroy it, God will destroy him,” stressing that it is not permissible to take money The flute with the intention of disrupting and causing harm, because God will not grant it success in this world and will hold it accountable in the Hereafter for that. People’s rights will not be forfeited on the Day of Resurrection unless their owners waive them, whether they are few or many.

And he pointed out that “the basic principle in a person, if he is forced by religion to fulfill his needs, is to be keen to return the rights to their owners after that.”

He added, “The purposes of the Sharia came to preserve the rights and necessities of every human being, and foremost among them is the preservation of money, and all of them are in the interest of the Muslim, regardless of these legislations that some minors do not understand.”

Al-Fityani continued by saying: For example, we find that zakat is one of its purposes to grant the poor the right to own money and dispose of it, and to find the pleasure of that, and for this reason, every Muslim who has zakat must give from it to the poor so that they can possess it, and all people are equal in the right to obtain this money and livelihood and own it.

He pointed out that “those who manage these funds well and get out of their poverty and want, but there are those who misuse them and continue in a state of poverty and destitution, and go on the path of need and extend their hand to people.”

He noted that many people today fall into the circle of mistrust, and each of us wants to know why others borrowed money, why they got into trouble, why they became insolvent, and why he was not careful in managing money. Or a grocery store owner or a simple business.

Al-Fityani stressed that we must be more keen to relieve people, to avoid God’s wrath, and to overlook our sins in this way, and each one of us remembers the Islamic verses, hadiths and directives to relieve the distress of the insolvent, simplify their lives and facilitate their affairs so that God makes it easy for them in this world and the hereafter.

Concerning the role of the judiciary and judges today in contributing to mitigating their judgments and decisions against those against whom cases of debtors and insolvents are raised, Al-Fityani stressed that this is a point of view for her and her, and the judge cannot determine who wants to pay, who is serious about it, and who does not want to pay, but he is facing implementation Binding legal texts to preserve human rights and prevent people from attacking each other and be a deterrent, so that the debtor does not attack the creditor.

And he stressed that compassion and transgression must be in relations between people, adding, “But unfortunately today we are with the spread of those who underestimate people’s money and rights, and you are not aware that there is an account in the afterlife and that his work will not exceed his place until he fills everything he owes, and he must forget.” The judge of the earth remembers the judge of heaven, and we will all go to that place, for these people make the case difficult and sometimes make the creditors intolerant.”

Al-Fityani pointed out that it may be that the judges, who are human beings in their hearts, would like to tolerate all people and reconcile with each other, and not be subject to legal texts and criminal accountability that some end in imprisonment, but the application of laws to preserve the rights of the creditor and the debtor at the same time.

At the end of his speech to Al-Bawsala, he emphasized that compassion among people makes God’s mercy manifest on earth, and our Messenger, peace and blessings be upon him, and our true religion urged us all to have mercy on one another, so tolerance, pardon, and overlooking those in difficulty are among the actions that necessitate a great reward for every Muslim, but it must That there be an internal religious motive that holds the debtor responsible for his responsibilities towards the creditor, and that he does not depend on causing harm to others, and virility disappears and relieves people’s distress.”
