Al-Armouti comments on the decision to dismiss MP Al-Fayez…it is not within the jurisdiction of the council

The deputy and former head of the Bar Association, Saleh Al-Armouti, commented on the House of Representatives’ decision to dismiss Representative Muhammad Enad Al-Fayez.

Representative Al-Armouti said in a statement to “Al-Bawsala” that what was mentioned in the rationale for the decision to dismiss MP Al-Fayez is considered to be within the jurisdiction of the judiciary.

The representative explained that the House of Representatives does not have the right to apply the Penal Code to any person, and this is a constitutional violation, while no member of the House of Representatives was able to discuss the report according to which Representative Al-Fayez was dismissed.

He added, “It is inconceivable that the deputy be attributed to violating the internal regulations of the House of Representatives, by collecting his financial allocations despite not attending the sessions of the Parliament,” while most of the representatives are absent from the sessions, and their allocations have not been deducted and they have not been punished.

Al-Armouti considered that the procedures that took place regarding the deputy were unconstitutional and illegal, and the council may not build on contrary decisions, and such a decision should not have been issued.

He stressed that the House of Representatives, which sets legislation and laws, must abide by the basic laws and guarantees for fair trials, and that we provide the opportunity for any person to defend himself against the charges against him. It is unreasonable or acceptable to take such a decision without the presence of the concerned person.

He wondered why the government had burdened the deputies with the decision to dismiss MP Al-Fayez, as it could have referred him to the court and then the House of Representatives would have a decision regarding him, pointing out that it is possible for the deputy to be exposed to legal accountability after the decision to dismiss him and strip him of his immunity.

The House of Representatives voted by majority on the Parliamentary Legal Committee’s decision to dismiss Representative Muhammad Al-Fayez, and 92 out of 110 deputies who attended the session voted for the dismissal decision.
