“I have been married for four years, and unfortunately, my father refused to attend the books of the book, and authorized my cousin to contract it, and a list of movables was not written to me, which made me in an unenviable position and pursued with big problems from my husband and his family, and my luggage and my private belongings all belong to my mother-in-law on the pretext that the apartment The one we used to live in belonged to my husband’s uncle and he took it back now, because I am about to separate, and I have a two-year-old child who is pregnant and with another child and I lost all my legal rights, the marital home and my movables.” And the question I am looking for is an answer: “If a separation occurs, what is the legal action?” What can I do to retrieve my belongings and stay in the nursery apartment?“

We transferred the question to the legal advisor, lawyer Dina Al-Mokadam, and she said: “The legal solution in such cases is for the complainant to file a statement of empowerment because she is a custodian, and she has to stay in her apartment with her children. It entails several rights for women, including the marital home “the place where the husband provides for his wife and they reside there.” According to the law, the wife, upon divorce, has the right to obtain it with her children.“.
And the legal advisor continued: There are several steps that can be followed if she establishes a claim to enable a nursery residence, at first she must write a report at the police department requesting the empowerment of the apartment, then she resorts to submitting within the record the marriage certificate, or divorce certificate, and her complaint is attached by submitting birth certificates for young children It is customary for the prosecution to keep the record administratively, so the complainant responds to the prosecution’s keeping by submitting a grievance against the decision to keep the record.“.
The lawyer added: “The Public Prosecution orders investigations by the detectives, and if the investigations prove that the complainant was residing in the apartment that is the subject of the complaint, she and her young ones, a decision is issued to enable her to the marital home, in partnership with the husband, and if she is divorced, the decision to empower her is issued only, and the period of empowerment is from one month. And a half for three months until a final decision is issued by the court.
The legal advisor indicated: “The married woman has the right to file a lawsuit in the family court demanding that the marital home be enabled, as it has become a nursery home.“.
