The Compass – Article 389 of the Jordanian Penal Code has entered into force since the day before yesterday, which deals with the issue of beggary, especially repeat offenders.
Social Development Minister Ayman Al-Mufleh said that as of Friday, Article 389 has entered into force, considering that its application will contribute to reducing the phenomenon of beggary, adding in a tweet to his Twitter account. Everyone must cooperate from public security salaries, the Greater Amman Municipality, municipalities, and citizens; To reduce this phenomenon and eliminate begging.
Article (389) of Penal Code No. (10) of 2022 states that: “A penalty of imprisonment for a period of no less than three months and not more than a year shall be inflicted on whoever gives or asks for charity from people on the pretext of that by exposing him to wounds or infirmity, or fabricating them, or by any means. Others, whether he was wandering or sitting in a public place.”…or “found driving a minor under sixteen years of age to beg and collecting alms, or encouraging him to do so, or offering with the intention of begging trivial goods, show games, or any other business that by itself is not suitable as a serious resource. for living”,
Or “use any other means of fraud to elicit the sympathy of the public with the intent of begging, or find a courier or traveler from one place to another to collect alms or charitable donations of any kind based on a false allegation.”
The second clause of the same article states that “the seized funds, things and tools shall be confiscated from the possession of whoever committed any of the acts stipulated in paragraph (1) of this article, and the court shall order their handing over to the Ministry of Social Development for disbursement to the agencies and institutions concerned with beggars.”
As for the third, it states that “in the event of a repetition of any of the acts stipulated in Paragraph 1 of this Article, the penalty shall not be less than six months, and discretionary mitigating reasons may not be used, and the judicial police at the Ministry of Social Development are obliged to include in its report evidence of recurrence cases for the defendant.” The fourth clause states that “without prejudice to any more severe penalty stipulated in any other legislation, whoever compels others to commit any of the acts stipulated in Paragraph 1 of this Article shall be punished by imprisonment for a period of no less than two years.” As for the fifth, “The Minister of Social Development may assign one or more employees to investigate the crimes mentioned in this article, arrest the perpetrators, and refer them to the competent judicial authorities. For this purpose, the assigned employee shall have the capacity of a judicial police.”
According to the Ministry of Development, beggary has become a profession, and it has been proven that all beggars who are dealt with are not worthy, as the ministry has recently seized a number of beggars who own property or have private businesses, or work in the public or private sectors. Not only that, but the employees of one of the anti-begging teams were assaulted by one of the adult beggars with a white weapon (knives), while the squad tried to seize him, he and his adult beggars while they were performing their duty to apprehend the beggars near one of the traffic lights in the Deir Ghbar area According to the ministry.
When trying to apprehend one of them, the other beggars threw stones at the employees and tried to assault and curse them, and then they fled. And one of the beggars called the anti-begging teams via the hotline, threatening the employees and swearing at them with obscene words that infringe dignity, outrage modesty and threaten to kill, according to the ministry. According to a report issued by the ministry last May, the cadres of the Anti-Begging Directorate seized 1,023 beggars, one of whom was a mocker and 397 repeaters, and conducted 370 campaigns, while the total amounts seized amounted to 1941 dinars. Experts had called for the necessity of activating Clause No. 2 of Article 389 of the Penal Code related to beggary crimes and toughening penalties to deter perpetrators or repeat offenders by amending the text of the article through the legislative channels according to the rules.
