Today, Wednesday, the Judicial Authority for Corruption Felonies at the Amman Penal Magistrate’s Court convicted three employees of the crime of neglecting the duties of the job, in violation of the provisions of Article (183/1) of the Jordanian Penal Code and in accordance with Articles (16 and 23) of the Integrity and Anti-Corruption Law.
The court issued its decision today, headed by Judge Dr. Uday Al-Fraihat, as the facts of the case were summarized by a company importing solid Jameed from the country of origin in Syria, and during the clearance of the consignment and after taking samples for examination, the laboratory results showed that the sample violated the Jordanian standard specifications.
The court’s decision indicated that the consignment contained benzoic acid at a higher percentage than the permissible limit, according to the Jordanian technical rule. As a result, the importer submitted a request to convert the consignment to liquid frozen, and the approval of the Food and Drug General Corporation was issued, provided that the conversion takes place under the supervision of the employees of the representatives of the General Corporation. of food and medicine, and that samples are drawn from the final product for the purposes of conducting laboratory tests.
According to the decision, the process of conversion and examination took place, as it was found that the goods were identical in terms of number and quantity produced with the approved manufacturing equation for the origin of the imported quantity, but when checking the customs transaction, several violations were committed by the defendants, represented in the failure to supervise the loading and transportation of the goods from The importer’s warehouses to the processing plant, the failure to seize the quantities inside the factory, the failure to inform the importer that the transfer process needs 14 days to take place under the supervision of the institution’s representatives, the failure to assign to the head of the department when violations are discovered, and the failure to follow the instructions of the Food and Drug Administration regarding correcting the errors that have occurred.
The court concluded that the actions of the defendants constituted all the pillars of the crime of neglecting the duties of the job, and they were sentenced to imprisonment for a period of four months and fees, and because the defendants were employees and no financial damage was incurred as a result of their actions, what the court considered of the discretionary mitigating reasons, and pursuant to the provisions of Article (100) of The Penal Code The penalty was reduced to one month’s imprisonment and the payment of fees.
