Today, Wednesday, the High Criminal Court issued a decision acquitting two people and a woman, whose husband had accused them of indecent assault on him by photographing him naked, in addition to accusing them of stealing 1,700 dinars from him, but the court found that the lawsuit was “malicious.”

The details of the case show that, about a year ago, the woman called her husband, and asked him to come to the house, and after he went home, he was surprised by the presence of a person, and his wife’s sister. 1,700 dinars were in his wallet, then the victim left without being able to file a complaint, because there were security requests against him.

The victim stated to the court that there were differences between him and his accused wife, and that his relationship with her was “bad”, and he visited her intermittently, while the accused was able, through defensive evidence, to prove that the complainant (the victim) does not come to his wife’s house, and that the children are always present with their mother, and that The jurisprudence of the Court of Cassation established that the inaction in submitting the complaint was malicious evidence.

Because of the contradictions contained in the complainant’s testimony and his acknowledgment of inaction in submitting the complaint, and the existence of differences between the complainant and his accused wife, the court was not convinced of what was stated in his testimony, as it was not without maliciousness, purpose and interest, while the court excluded the complainant’s testimony from the defensive evidence to prove the case, and when it was excluded It was found that there was no legal evidence linking the accused to the crimes charged against them.

In conclusion, the court decided to acquit the defendants of the crimes ascribed to them, which are the felony of indecent assault, theft, the misdemeanour of threatening to expose, carrying and possessing a sharp weapon.
