Appealing the extension of Sheikh Salah’s dismissal

The defense team of the head of the Islamic movement inside the occupied occupied territories, Sheikh Raed Salah, submitted an appeal to the Israeli Supreme Court against the decision to extend his solitary confinement in Ramon Prison until the end of his sentence.

The defense team demanded the appeal, the “Supreme Court” to annul the decision of the Central Occupation Court in Beersheba to extend the isolation of Sheikh Salah in “Ramon” prison until the end of his sentence on the background of the “constant file”, where the full sentence ends on January 24, 2022.

He also demanded that Sheikh Salah be transferred to the regular prison sections, given the repercussions of his solitary confinement on his physical and psychological health.

He stressed that “Israeli law confirms that the imprisonment of a person does not nullify his guaranteed basic rights, and that these rights are preserved inside the prison and inside his cell, especially with regard to the safety and health of his body.”

The appeal stressed that the continued isolation of the prisoner, Raed Salah, caused him health and psychological suffering, and that he was exposed to great health risks.

The appellants rejected the decision of the Central Court not to agree to summon representatives of the prison authority to attend the court’s deliberations and the counter-investigation with them by the defense staff on the justifications for the request to extend the isolation of Sheikh Salah.

In the context, it stated: “The initiative by the Prison Authority to request an extension of the isolation of Sheikh Raed is a procedure that calls for judicial deliberations and requires that the Public Prosecution and the Prisons Authority provide justifications for their allegations and objective evidence to justify the extension of the isolation, and therefore the appellant has the right to discuss the parties calling for his dismissal in the reasons and evidence. The Central Court erred in not agreeing to the defense team’s request to summon representatives of the Prisons Authority in this regard.”

The appeal clarified that the court’s refusal to summon representatives of the prison authority would raise doubts about the entire procedure of solitary confinement against Sheikh Salah and its legality, which began more than a year ago at the moment of his arrest in the file in question.

He demanded that the author of the social report on Sheikh Salah be summoned and that this report be updated in light of the compelling circumstances and the suffering he is experiencing.

The appeal questioned all the justifications presented by the prosecution to justify and extend the solitary confinement, stressing that they are justifications based on analyzes and so-called classified materials, which do not rise to the level of objective evidence.

On 08/18/2021, the Central Occupation Court responded to the request of the Occupation Public Prosecution and the Prisons Authority, to extend the solitary confinement of Sheikh Salah until the end of his sentence in the “constant file,” claiming that he “poses a threat to the security of the state and committed 3 violations by supporting an illegal organization ( The Islamic Movement, banned by Israel), and 3 offenses of incitement to terrorism.

Sheikh Salah has been detained since August 16 of last year, and suffers from difficult conditions in the occupation prisons, in which he is serving a 28-month prison sentence, of which he spent 11 months.
